Terms and Conditions

You must be 21 years old or older to be in any Society or purchase any beer from The Bruery. A Preservation Society membership applies to the quarter following the successful rebilling of quarterly membership fees. The retail value of the quarterly Preservation package is based on a the retail value of package contents. The Bruery may change prices (including membership price or retail prices) at its own discretion, effective upon notice and posting. The Bruery may substitute any scheduled beer for another beer or other merchandise. Discounts, if any, may be subject to change.

For members who select California as their fulfillment center (by purchasing a “Reserve Society – CA” or “Hoarders Society CA” membership for 2018), sales are deemed to occur in Placentia, California, thus CA (Placentia area) sales tax will be applied to all orders at the current prevailing rate (7.75% as of 9/1/17). For members who select Washington, D.C. as their fulfillment center (by purchasing a “Reserve Society – DC” or “Hoarders Society DC” membership for 2018), sales are deemed to occur in Washington, D.C., thus, the Washington, D.C. sales tax rate for liquor sold for off-premise and on-premise consumption will be applied to all orders at the current prevailing rate (10% as of 9/1/17).

Billing

The Preservation Society is an ongoing subscription. You will be automatically be charged $70 at the beginning of each quarter. You understand that your Preservation Society Membership will automatically renew each quarter and you authorize us (without notice to you, unless required by applicable law) to collect the then-applicable membership fee and any taxes, using any credit card we have on record for you.

Cancellation of Membership

Preservation Society members may be removed from future billings at any time. To cancel, please contact us at society@thebruery.com anytime before the recurring billing for the quarter takes place. You must notify us prior to the your renewal. Please note that we will not issue refunds for any reason, for a quarter that has already been billed. Memberships are designed to be held by one person, and all associated benefits may only be exercised by that person during the membership term. Memberships are non-transferable and all membership purchases are final, subject to the right of The Bruery to cancel or terminate a membership in accordance with this Agreement. The Bruery reserves the right to cancel and terminate a membership at any time and for any reason, effective immediately upon notice. Such reasons may include, but are not limited to, abuse of state or federal alcohol related laws, attempted shipments to minors, Society members reselling Society beer at retail establishments (regardless of whether the membership account is in the name of a retail establishment or an individual’s name), reselling of beer without required licenses, or other reasons that The Bruery may determine in its sole and absolute discretion. If The Bruery cancels a membership, a member’s sole recourse is limited to a refund of the fee assessed for the quarter minus the non-discounted retail value of any beers included with his/her membership level that have not already been picked up, or released by The Bruery, by the appropriate pickup deadline window (see Preservation Society Time Table below). Applicable refunds shall be made within thirty (30) days of cancellation notice.

Pickup, Shipping and Storage

Society Members enjoy the privilege of picking up online beer purchases in person at our Society Fulfillment Center. Shipping within California is also available, at an additional cost. Recipients of beer shipped within California must be at least 21 years old and must be available to sign for their beer deliveries and verify their age. We are not able to ship outside of California. If you are outside of California, please designate a trustee within California who is over 21 years of age to pickup or receive shipment of your beers. Proof of age is required to be provided for both the member and trustee at time of pick-up. The Bruery is not responsible for and will not issue refunds for any beer once released to a trustee.

Preservation Society membership also includes the benefit of climate controlled storage of online allocation purchases for a certain period of time, generally for three months following the end of the calendar quarter in which the sale occurred (see Preservation Society Time Table below). Following a quarterly pickup deadline, The Bruery will, at our sole discretion and at additional cost to you, attempt to ship all outstanding orders for which we have a valid credit card and California shipping address on file within 30 days following the close of the quarter.

The Bruery will not issue refunds or exchanges for any items that are not picked up or shipped by the appropriate deadlines, or which cannot be successfully delivered to a California address on file for any reason. The Bruery is not responsible for any change or failure to change your shipping information that may result in your beer being undeliverable. You will be responsible for any additional charges that may occur due to reshipping in the event that a delivery attempt fails. The Bruery is not responsible for any beer or merchandise once it has been signed for and picked up by a member or a trustee. Please allow yourself adequate time to check the accuracy of all orders before taking possession of the beer.

How much is it to join the Preservation Society?

The quarterly membership fee to join the Preservation Society is $70. Taxes and optional shipping are extra.

What are the benefits of membership in the Preservation Society?

Each quarter, Preservation Society members receive a number of benefits. The cornerstone is the specially-curated, quarterly Preservation Society package, which typically includes three to four bottles with a value a retail value of $100. Generally, each quarter’s beers will include a barrel-aged strong ale from The Bruery, a barrel-aged sour or wild ale from Bruery Terreux, and a limited, special release, experimental beer. Some of these beers may be exclusive to our membership Societies. Unfortunately, beers cannot be substituted.

Members also receive priority enrollment in our Reserve Society in the fall (for membership the following calendar year) in advance of any public sale (if any). In addition, Preservation Society members enjoy access to special beers at The Bruery Tasting Room and Bruery Terreux Tasting Room, plus special sales and allocations throughout the year, and access to special events. Preservation Society members receive a loyalty discount of 10% off their all purchases.

When will I receive my beers?

Preservation Society members will receive a quarterly Preservation Society package each calendar quarter. We will typically release or ship the beer at the end of the quarter, or within the first few weeks of the subsequent quarter.

When do I need to pickup my beers?

Any beers purchased within a given quarter, including that quarter’s Preservation Society package, must be picked up or shipped by the end of the subsequent quarter. Specific dates can be found in the see Preservation Society Time Table above. At the end of a quarterly deadline, we will attempt to ship (at additional cost) any beer purchased, including that quarter’s Preservation Society package, to members for whom we have a valid California address and credit card on file. REFUNDS WILL NOT BE ISSUED FOR ORDERS THAT ARE NOT PICKED UP OR SHIPPED WITHIN THE DESIGNATED TIMEFRAME, or which cannot be successfully delivered to the California address on file for any reason.

Will The Bruery ship my beer purchases?

Yes, we will ship within California. Regretfully, we cannot yet ship beer to other states, so this service is limited to our California members. Members in other states can either pick up their allocation at The Bruery or arrange for someone else to pick it up on your behalf (we call these kind folks, “Trustees”). The Bruery is not responsible for any allocation picked up by a member or their Trustee. To ship your beer, select “GSO Ground” from the shipping option. Beer will be shipped through Golden State Overnight. An adult signature (21+) is required at the time of delivery and so we recommend that you use a business address for delivery if you are unable to sign for your package at your home during the day.

In addition to the quarterly Preservation Society package included with your membership fee, we typically release two to three limited edition beers to our Preservation Society that will not see a public release each quarter. If you feel these additional releases may be of interest to you, please take a moment to familiarize yourself with our Flexible Shipping Options. We offer these to members of our Societies as a means to minimize shipping costs over the course of your membership.

How can I change my shipping address?

To change your shipping address, navigate to Account section of the website. If you wish to change your shipping address associated with your Preservation Society membership, please do so prior to the billing period in the “Payment Profile Section”. We are not responsible for any change or failure to change your shipping information that may result in your beer being undeliverable. You will be responsible for any additional charges that may occur due to reshipping, or undeliverable beer.

Can I pick up my beer, instead of shipping?

Absolutely. To pick up your quarterly beers, select “Pick Up” from the shipping option when you enroll. You may pick up your quarterly beers generally at the beginning of the next quarter. We will send a notification when beers will be available. To make your pickup experience as pleasant as possible, we request that all members email our Society Associates at society@thebruery.com at least 24 hours prior to visiting us. During busy periods, we reserve the right to prioritize customer service to members who have emailed in advance over walk-ins.

If you’ve already joined Preservation Society and would prefer to pick up your beer rather than having them shipped to you, please email society@thebruery.com at least two weeks before order fulfillment for that quarter. We regret that we cannot process changes to shipping methods within two weeks of order fulfillment.

When will my credit card be charged?

Your credit card will initially be charged when you enroll in the Preservation Society. Subsequent charges for ongoing subscription will automatically be assessed within the first two weeks of each quarter. For ongoing subscription charges, we will attempt to send out an email notice to all email addresses on file before applying the charge. Please update your credit card, address and account information. If a charge does not go through, we may attempt to charge your card again. However, if we are unable to process payment, your membership will be canceled and you will need to re-register for Preservation Society membership.

How can I cancel my subscription?

Preservation Society Members may cancel their membership at any time. To cancel, please contact the Society desk at society@thebruery.com anytime before the recurring billing for that quarter takes place. Please note that we will not issue a refund for Preservation Quarters that have already been billed. Please refer to the chart above for billing and shipment/pickup periods.

Can I get a refund for broken bottles?

If your shipment arrives with any of the bottles broken, please email society@thebruery.com explaining the situation and what was broken in your shipment. Unfortunately, we cannot provide refunds for any bottles shipped through a Trustee, or picked up directly from our Tasting Room.

Is Preservation Society Membership limited?

Yes. In order to provide members with limited release beer and help plan our production, we must cap the number of members in our Preservation Society. We may change the number of members from time to time, but once our cap is met, we will not be taking any new members.

Can this work as a Corporate Gifts Program for my employees?

You bet! The Preservation Society is an ideal corporate gift program to reward your employees from quarter-to-quarter. Simply select the number of memberships you’d like to purchase for your employees, add them to your cart and enter your office address as the shipping destination. You’ll then be enrolled to receive shipments of our quarterly Preservation Society packages for your employees each quarter. Each quarterly package arrives in a collectible box with literature on each of the three included beers. Not only does the beer inside make a statement, but the box itself is quite gift-worthy as well.

A word about timing

Many of our beers are bottle conditioned. We brew, package and plan to ship beer as scheduled, but from time to time shipments may be delayed while we coax Mother Nature to do her thing. In the event that a scheduled beer does not meet our quality standards, we may delay shipping to the extent manufacture of the applicable beer is delayed, or replace a scheduled beer with another beer of similar retail value. We will give you notice to your email on record if there is ever an extended delay. If a replacement beer has a lower value than the scheduled beer, we may include merchandise of an amount equal to at least the difference in the scheduled beer and the replacement beer.

Reserve Society and Hoarders Society members who purchase a 2019 membership for CA fulfillment have until February 28, 2020 to pickup or ship (within CA) their beer purchases from the 2019 calendar year. An email at least 24 hours in advance of a planned pickup is required. Reserve Society and Hoarders Society members who purchase a 2019 membership for DC fulfillment have until February 28, 2020 to pickup their beer purchases from the 2019 calendar year from our DC store. Members who purchase a DC membership must email their request for beer purchases to be sent to the DC store for pickup. When the beer arrives at the DC store, members will be notified that it is ready for pickup. Members will have 30 days to pickup beer from the DC store. Members who are unable to pickup the beer they requested for pickup from the DC store will assessed a $2 restocking fee per bottle. A new request will be required to schedule another DC shipment/pickup.

There are many benefits for joining.

When can I join?

Priority re-enrollment for the membership year begins the preceding fall. Reserve Society members receive priority registration. Preservation Society members receive the opportunity to join, as space is available, on a first-come, first-served basis. General registration for the Reserve Society will begin after the Preservation Society priority period, if space is available. Specific dates are subject to change. We regret that we cannot guarantee any spots after priority periods have passed.

When will I receive my beers?

An initial package will be available for pickup from CA or DC (depending on your selected location) or shipping within CA near the beginning of the calendar year. Other included beers will be available at various times during the year. We try to schedule and communicate when we expect to release beers, but sometimes the beer dictates its schedule to us, rather than the other way around. We apologize in advance for any delays that you’ll encounter during the year. Be advised that exact quantities of beer provided as part of the membership vary from year to year.

Will The Bruery ship my allocation?

Yes, we will ship beer within California. Regretfully, we cannot yet ship beer to other states, so this service is limited to our California members. Members in other states can either pickup their allocation at The Bruery or DC store (depending on the fulfillment center location selected for their membership), arrange for someone else to pick it up on your behalf, or shipped to a California address (we call these kind folks “Trustees”). Members who purchase a DC membership (and/or their trustees) will be able to pickup beer purchases from The Bruery Store at Union Market. The Bruery is not responsible for any order once it has been signed for and picked up by a member or their Trustee. Please allow yourself adequate time to check the accuracy of all orders before taking possession of the beer. We are not responsible for replacing orders after they have been signed for. It is your responsibility as a member to communicate with your Trustee about what orders need to be picked up. We cannot split orders, if any beer in an order has not been released, we will hold the order until all beer is available. To ship your beer in CA, select “GSO Ground” from the shipping option. Beer will be shipped through Golden State Overnight. What are Flex Shippers?

There are two ways to have your beer shipped in CA: (1) You can either choose to ship a single order instantly by selecting the “Ship” option during the purchase. (2) Or, you can combine multiple orders and ship them at a later date using one of our Flex Shippers. If you plan to combine orders and ship with a Flex Shipper option, then select the “Pick Up” option when you purchase your beer. When you are ready to ship, purchase a Flex Shipper in either 3, 6, 9, or 12 bottle sizes. Our staff will then fill and ship your Flex Shipper with any beers or merchandise that you have been allocated or purchased.

How can I change my shipping options?

The Bruery will not issue refunds or exchanges for any items that are not picked up or shipped by these deadlines.

Are the beers we receive exclusive to the Hoarders Society and Reserve Society?

Some beers will be more limited and/or exclusive in nature, such as beers included with a Society membership. Other beers may be “exclusive” to the extent that no quantities remain following a Society allocation. We will try to indicate in advance which beers are intended as exclusive and which beers are intended to be offered to others. The amount we produce of each brand will greatly impact which beers may be available to others following their Society release. We plan our production to meet the demand of our Societies; however, our projections may be off occasionally. In fact, to the extent that sales during a Society allocation period exceed our expectations, every Society member may not be able to purchase a specific beer. As such, we encourage members to purchase the beers they are excited about early in the allocation period. To the extent that sales may not meet our expectations during an allocation period, we reserve the right to offer such beers for sale to other Societies, in our Tasting Rooms and/or to the general public. We may also choose to serve Society beers on tap and in bottle in our Tasting Rooms and at events.

When will beers be offered for sale?

We intend to offer new beers for sale on the first Monday of each month. Typically, Reserve Society members will have the opportunity to purchase 2-4 bottles of each beer respectively. Hoarders Society members will generally, but not always, receive double the allocation limit. Some releases may have higher or lower allocation limits, depending on production yields. If there is sufficient inventory remaining, we may re-release the beers to Society members and/or the general public.
Our sales schedule may change for many possible reasons, including that the planned beers are not ready, there is insufficient inventory, or any other reason in our discretion.
We also have special sales and allocations throughout the year.

Is membership limited?

Yes, we have a cap on memberships in all Societies. Current members generally will have priority re-enrollment opportunity. Any available spaces in Reserve Society will then be offered to Preservation Society members. If there are any spaces after the sale to Preservation Society, they will be offered to the general public until full.
A word about timing.
Many of The Bruery beers are aged for long periods of time in oak barrels, and many are bottle conditioned. We brew, package and plan to ship beer as scheduled, but from time to time shipments may be delayed while we coax Mother Nature to do her thing. In the event that an allocated beer does not meet our quality standards, we may delay releasing the applicable beer, or choose not release a beer at all. If a beer included in the membership or already paid for as an allocation does not meet our quality standards, we may replace the beer with a beer or merchandise of equal or greater value, or we may refund the retail amount (if included in membership). For other purchased allocations, we may refund what has been paid for that particular beer. Additionally, we cannot release any beer before the announced release date.

Why aren’t events included in the membership fees?

Society members join us from across the state and around the country. Including event entry into the membership fees would mean that many of those members would not be able to take advantage of one of the benefits that they would have paid for. Having the events as an additional fee allows us to include more beer as part of the membership fees and helps ensure that members are receiving the value for which they’ve paid.
